Terms of Service

1. Acceptance of terms

By accessing or using Chattyio ("the Service") at chattyio.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time; continued use after an update constitutes acceptance.

2. Eligibility — 18+ only

You must be at least 18 years old to use Chattyio. By using the Service, you represent and warrant that you are 18 or older. We reserve the right to terminate access for any user we have reason to believe is under 18. Parents and guardians are responsible for ensuring minors do not access this Service.

3. Prohibited conduct

You agree not to use the Service to:

  • — Transmit, solicit, or facilitate child sexual abuse material (CSAM) or any sexual content involving minors.
  • — Engage in sexual exploitation, grooming, coercion, or human trafficking.
  • — Harass, threaten, defame, or intimidate any person.
  • — Transmit hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • — Engage in spamming, phishing, or distributing malware.
  • — Facilitate or discuss illegal activities including drug sales or weapons trafficking.
  • — Impersonate any person, company, or entity.
  • — Attempt to circumvent any technical measures including rate limits, bot detection, or IP blocks.
  • — Use automated scripts or bots to access or abuse the Service.

Violations may result in immediate termination of access and, where required or appropriate, reporting to law enforcement.

4. Content and messages

You are solely responsible for all content you transmit through the Service. You represent and warrant that your messages do not violate any law or these Terms.

Chattyio does not store messages. All conversation data exists only in the memory of participating browsers for the duration of the session. We have no ability to review, moderate, or recover past messages.

5. Reporting & enforcement

Any user may report another user using the in-app Report function. Upon receipt of a report, the reported user is immediately disconnected and their IP address is blocked for 24 hours. Chattyio cooperates fully with law enforcement investigations and will disclose identifying information when required by valid legal process.

Chattyio complies with the requirements of 18 U.S.C. § 2258A and reports apparent violations involving CSAM to the NCMEC CyberTipline.

6. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHATTYIO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED $100 USD.

8. Section 230 notice

Chattyio is an interactive computer service as defined under 47 U.S.C. § 230. We are not the publisher or speaker of user-generated content transmitted through the Service and are not liable for content created by third parties.

9. Termination

We may terminate or suspend your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the public.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved exclusively in the federal or state courts of the United States, and you consent to personal jurisdiction in those courts.
